Special Services
The Kimberly School District Department of Special Services is available to provide a variety of services to the students who attend school here. You may not be aware that we are also available to provide the same services to children who live within the district boundaries and are either home schooled or attend private schools.
Among the services we provide to those children who qualify are academic, psychological, and speech/language testing; speech and language therapy, individualized instruction in academic skills. If you have a child or know of a child who might need any of these services, please call our Special Education Office at 423-4170 extension 3309.

FERPA
The Family Educational Rights and Privacy Act (FERPA) afford parents and students over 18 years of age (“eligible students”) the following rights with respect to the student’s education records:
1. The right to inspect and review the student’s education records within 45 days of the day the district receives a request for access. The parent or eligible student should submit to the school principal a written request that identifies the record(s) he or she wishes to inspect. The principal will make arrangements for access and notify the parent or eligible student of the time and place where the records may be inspected.
2. The right to request an amendment of the student’s education record that is believed to be inaccurate or misleading. The parent or eligible student should make a written request for an amendment of records to the school principal by clearly identifying the part of the record that needs to be changed and specifying why it is inaccurate or misleading. If the district decides not to amend the record as requested, the parent or eligible student will be notified of the decision and advised of the right to a district hearing regarding the request.
3. The right to consent to disclosures of personally identifiable information contained in the student’s education records, except to the extent that FERPA authorizes disclosure without consent. One exception that permits disclosure without consent is to school officials with legitimate educational interests. A school official is a person employed by the district as an administrator, supervisor, teacher, or support staff member (including health staff and law enforcement personnel); a person serving on the board of trustees; a person or company that the district has contracted to perform a special task; or a parent or student serving on an official committee, such as a disciplinary or grievance committee, or assisting another school official in performing his or her tasks. A school official has a legitimate educational interest if the official needs to review an education record to fulfill his or her professional responsibility. Upon request, the district will disclose education records without consent to officials of another school district in which a student seeks or intends to enroll.
4. The right to file a complaint with the U.S. Department of Education concerning alleged failures by the district to comply with the requirements of FERPA. The office that administers FERPA is:

El acta de privacidad y derechos educacionales de la familia (FERPA) les otorga a los padres y estudiantes mayores de 18 años(“estudiantes que califican”) los siguientes derechos con respecto a los expedientes de educación de el estudiante:
1. El derecho de inspeccionar y revisar el expediente educativo dentro de los 45 días a partir de el día que el distrito recibe la petición para el acceso. 2. El derecho de peticionar una enmienda a el expediente educativo que crea que es inexacto o engañoso. El padre o estudiante elegible deberán de peticionar por escrito una enmienda de el expediente al director de la escuela identificando claramente la parte de el expediente que deberá de ser cambiado y el por que es inexacto o engañoso. Si el distrito decide no enmendar el expediente como fue peticionado, el padre o estudiante elegible serán notificados de la decisión y avisados sobre su derecho de una audiencia con el distrito acerca de su petición.
3. El derecho de dar su consentimiento a compartir información personal identificable contenida en los expedientes educativos de el estudiante, excepto al grado que FERPA autoriza el compartir sin informar. Una excepción que permito compartir la información sin el consentimiento es a los oficiales escolares con legitimo interés educativo. Un oficial educativo es una persona empleada por el distrito como administrador, supervisor, maestro, personal de apoyo ( incluyendo personal de salud y personal que aplica las leyes); una persona que sirve en el consejo en gestión; una persona o compania que el distrito ha contratado para el desempeño de una tarea especial; o un padre o estudiante sirviendo en un comité oficial, como un comité de disciplina o agravio, o para asistir a un oficial de otra escuela en la ejecución de su tarea. Un oficial escolar tiene el interés legitimo educativo si el oficial necesita revisar el expediente educativo par llevar acabo su responsabilidad profesional. A petición, el distrito compartirá expedientes educativos sin el consentimiento a oficiales de otro distrito escolar al cual el estudiante busca o piensa inscribirse.
4. El derecho a archivar un queja con el Departamento de Educación de EU respecto a fallas alegadas por el distrito de no cumplir los requisitos de FERPA . La oficina que administra a PERPA es:

CHILD FIND
The Kimberly School District, in cooperation with parents and nonpublic school agencies, engages in Child Find services throughout the school year. Child Find activities are conducted (1) to create public awareness of special education programs, (2) to advise the public of the rights of students, and (3) to alert community residents of the need for identifying and serving children with disabilities from the age of 3 through the semester in which they turn 21.
If you know of a child who is 3 through 21 years of age who may have individual needs that result from disabilities or developmental delays, and who is not enrolled in a school program, please contact Mrs. Reese, Special Education Director, 208-423-4170 ext. 3309 or the school district office at 208-423-4170 ext. 3309. These children may have difficulty walking, talking, hearing, or learning, or may display behaviors that appear different from other children their age.
The district is also responsible for coordinating with the Department of Health and Welfare regarding the Child Find system for children ages birth through 2 years. The Child Find system includes children with disabilities who are homeless, as defined by the McKinney-Vento Homeless Act, wards of the state, or attending private schools, regardless of the severity of the disability.

EXPEDIENTES DE LA EDUCACIÓN ESPECIAL
