Special Education and the Law:

Federal and State Laws specify three pieces of legistation to assist those persons with special needs.

IDEA

The Individuals with Disabilities Act is a federal education law that provides resources to states in providing special education services to children ages 3 - 21. IDEA guarantees a free and appropriate education (FAPE) for qualifying children.

The Rehabilitation Act of 1973

Section 504 of teh Rehabilitation Act that prohibits discrimination on the basis of disability.

ADA

The Americans with Disabilities Act protects the rights of individuals with disabilities as well as prohibiting discrimination.

 

Special Education Eligibility

Students who meet certain criteria are eligible for special education under one or a combination of the following disabilities:

Cognitive Impairment
Deaf-Blindness
Deafness
Developmental Delay
Emotional Disturbance
Fluency Disorder
Health Impairment
Hearing Impairment
Learning Disability
Multiple Disabilities

Traumatic Brain Injury
Visual Impairment (Including Blindness)
Voice Disorder

Preparing Students for the Future

Determination for eligibility usually begins with a pre-referral to an evaluation team at the school site.

Once the school team determines an evaluation is necessary, the type of assessment(s) that may be needed are determined. Parental consent is required before any assessment(s) can take place.

Students who are eligible for special education are entitled to an Individualized Education Plan (IEP). The IEP is a written document detailing a program
designed to meet the needs of a student. The IEP is designed by a team of qualified individuals, including the parent(s), who meet to determine eligibility, specific needs,
and appropriate services.
